These Buying & Selling Terms & Conditions govern any transaction in which FBN Homes acts as the representing agent for a buyer or seller of residential or commercial property in Kamra, Hazro, Attock and the surrounding GT Road corridor.
1. Professional Fee
FBN Homes charges a flat professional fee of 1% of the final agreed transaction value for a successfully completed sale or purchase, payable by the party who appointed FBN Homes as their representing agent, unless a different arrangement is agreed in writing before the transaction begins.
2. The 0% Loyalty Selling Fee
If the property being sold is currently under FBN Homes property management (see our Property Management Terms), the standard 1% selling fee is waived entirely for that Owner.
3. Verification of Title & Documents
FBN Homes conducts reasonable verification of ownership documents and property title before listing or facilitating a transaction, but the ultimate responsibility to confirm legal title rests with the buyer’s own legal counsel prior to transfer.
4. Token / Advance Payments
Any token money or advance paid to reserve a property will be documented in writing between the buyer and seller, with FBN Homes facilitating but not holding funds in escrow unless separately agreed.
5. No Dual-Agency Conflict
Where FBN Homes represents both a buyer and a seller in the same transaction, both parties will be informed in writing and FBN Homes will act with fairness and full disclosure to both sides.
6. Transaction Timeline
FBN Homes will provide a reasonable estimated timeline for completing documentation, transfer and possession, though timelines may be affected by third-party government transfer processes outside our control.
7. Cancellation
Should a transaction fail to complete due to circumstances attributable to the buyer or seller, any professional fee already earned for work performed up to that point remains payable, as detailed in the individual transaction agreement.
8. Overseas Pakistani Clients
Buyers or sellers residing abroad may complete transactions via a registered Power of Attorney; FBN Homes can guide clients on the documentation process. See also our Investor Terms & Conditions.
9. Governing Law
These Buying & Selling Terms are governed by the laws of Pakistan. Disputes shall first be addressed through good-faith negotiation before recourse to the courts of Attock District.
